Illegal Downloading

By Sonixpber on 18/07/2008
Hey guys, I got a cease and desist from my ISP today :X.

So basically I've downloaded over 30 movies, and it just happens that one of them (10,000 B.C.) was being tracked by MPAA. Btw thats a shitty movie, don't watch it XD.

Anyways my dad (Since he is the owner of our ISP account) got an e-mail from our ISP asking for some information. Possible legal action includes up to $150,000 USD fine or up to 5 years in jail. But in reality, I think its extremely unlikely anything will happen.

I'm a little scared, to be honest. But I don't think any legal action will be taken as long as we comply with the e-mail. Basically what we have to do is delete 10,000 B.C., disclose some personal information, provide the directory that the movie was located in before it was deleted, and under penalty of purgery, we must say in good faith that we believe the movie is no longer accessible.

I've heard of someone who has done way worse and paid $5,000 fine. Anyways I don't think this will stop me from DLing music, but theres no way in hell that I'm ever downloading a movie again lol.

You sure it isnt a scam?

The e-mail, I have checked, is from my ISP.

I'm not really worrying, I'm pretty sure everything will be fine

Tsk tsk, should be using a proxied port.

By Dorcha3377 on 18/07/2008
That is very scary, be wary its not worth it .

I live in Canada tongue.gif

I'm safe until that fuckin new law comes out. Holy shit that one's a doozy. Illegal to even record TV ffs. Fucking conservatives with their "made in Canada solution for copyrights" that looks almost identical if not worse than the US attitude towards copyright.

Only thing less severe are the penalties if you ask me.

fuck.

Yeah all you guys should take this as a warning as they are starting to do this in the UK aswell. They will soon be tracking downloaded movies and music off the internet so be careful if you must watch them online FFS like youtube etc as it is your own ISP that is starting to track what you are doing now i know in england atm is only a few but watch out because its being forced upon them to become more main stream. I myself have stopped downloading games now and only use youtube for music. Just make sure if you must do it at the very least use a proxy and try to cover yourself its just not worth it.

By Tnuac on 18/07/2008
Damn mike, that sounds bad. Hopefully you can escape it.

I've been trying to discover how risky music downloading is for some time.

By Geoff_Bland on 18/07/2008

By moonlite69 on 18/07/2008

By Havochaha on 18/07/2008
failboat always scan it for tracking programs or what ever you call them

By Sonixpber on 18/07/2008
Just a little update, it was a random check because we were using a lot of bandwidth this month (more than usual, because we haven't seriously started downloading movies until recently). And I usually get my share ratio between 1.5-2, highest has been 16.0.

My brother called my ISP today and got in contact with someone in their "Abuse tracker department." He was told that since its only our first time, its really just a verbal warning. All we have to do is reply to the e-mail saying that we removed the movie and the programs used to share the movie.

And how could it have been a scam? First of all, I already checked. Second of all, what could they possibly scam?

Anyways for those of you who are wondering, I think I'm already in the clear for the whole situation.

Sounds like you got off pretty well.

I've never downloaded a movie at all but I have ripped some DVDs, of course there's no way to get caught for that.

Do they do this with music too?

In America and Europe, they definitely do. Forunately, cases of people getting caught are few and far between, but when they are caught, they face hefty fines.

Not sure on how strict the regulations are down under though.

www.alluc.org it only streams but that's all you should do really, unless you are genuinley burning dvds and making profit, but in that case TUT TUT

SONIX GOT BURNED! dface-ani.gif

... hi biggrin.gif

By Sum-41xx on 21/07/2008
I would argue that the only reason that they say it was a "random check" was because they know that legally, invasion of personal privacy (which is technically what they did, but because they say it was a random check they're completely off the hook) is actually more illegal from what I'm aware of than illegally downloading.

Anyways, I know that for now in Canada it's not a big deal, but as Georgio is saying, maybe not for long.

By EckZr on 01/09/2008
Comcast sent me one of those

cuz my brother was a dumbass and used the official BitTorrent client for his downloads

i use those lesser known third party ones and download double the stuff he does

havent caught me yet.
